Official Rules: KL Randis Writing Contests / Cash Payouts

Promotion Period: The KL Randis Writing Contest will be made available on various dates throughout the month, and deadline to submit to the writing prompts will vary and be posted by 4pm EST (the “Promotion period”). Sponsor’s computer is the official time-keeping device for the KL Randis Writing Contest giveaway and can vary to be extended past the deadline time but will never be turned off prior to 4pm EST.

BY ENTERING (OR OTHERWISE PARTICIPATING IN) THE PROMOTION, ENTRANTS AGREE TO THESE OFFICIAL RULES, WHICH ARE A BINDING CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES TO THE PROMOTION PARTIES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.

In the event not enough ticket sales are collected from the KL Randis Writing Contest to payout both the Life Scholarship and Writing Contest winners, the winners may be postponed/contest may be rolled into the following month. So it is in your favor, if you are entering the Life Scholarship, to SHARE the KL Randis Writing Contest via your social media channels to ensure the Life Scholarship gets funded.

Eligibility

KL Randis Writing Contests by KL Randis is open only to legal residents of the fifty (50) United States who are at least the age of 18 at the time of entry. Employees/direct blood relatives of KL Randis, and their respective parents, affiliates, subsidiaries, and advertising, and promotion agencies, and any such employee’s immediate family members (spouse, parent, child, sibling and their respective spouses) and those living in their same households, whether or not related, are not eligible to enter or win a KL Randis Writing Contest. Void where prohibited by law. The KL Randis Writing Contest Program is subject to all applicable federal, state and local laws.

How to Enter

To enter, visit klrandis.com/writingcontest during the “Entry Period” and obtain an official entry form/ticket. Enter the Promotion by completely entering your correct contact information on the registration form (required fields include: Full Name and Email Address, contact information and acknowledgement of terms and conditions) to gain access to complete and submit the online KL Randis Writing Contest form writing prompt, of approximately no more than 1000 words with the writing prompt provided. Most entrants can and do submit responses of less than 6 sentences.

Limit of one Submission per person, per email address, & limit of one (1) approved Submission per person, per email address, throughout the given Entry Period. No refunds will be given for accidental or purposeful additional entries. No refunds will be given for ticket sales at all, under any circumstances, as ticket sales contribute to the funding of Safehaven homes run & Life Scholarships by KL Randis. The KL Randis Writing Contest drawing will occur at a later date in the same month as set forth elsewhere in these Official Rules and all over social media.

Online entries must be received by 4:00 p.m. EST on entry date specified. All entries will not be returned to the entrant. Limit one (1) entry per entrant. Entry must be submitted in English, be entrant’s original creation, be true and verifiable, created solely by entrant, with no restrictions or limitations on entrant’s right to submit, or Sponsor’s right to use, the entry. Entry may not have previously won a KL Randis Writing Contest from KL Randis Writing Contests by KL Randis in the previous 3 months. Entry must be 100% original and not contain third party materials subject to copyright including but not limited to music lyrics, artwork and photos or writings not of the entrants copyright or original work. Entry can not be modified, added to, replaced or altered once submitted to keep the entrant & entry anonymous from the judges. Entry cannot defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights. Modifying, enhancing or altering a third party’s pre-existing work does not qualify as entrant’s original creation. Entry may not be offensive or inappropriate, as determined by judges in their sole discretion. Sponsor reserves the right to disqualify any entry it deems to be inappropriate, offensive or is not in keeping with Sponsor’s image, in its sole discretion.

CAN I EMAIL OR FAX MY APPLICATION?

No. Under no circumstances should entries be emailed or direct messaged to Kelly or Mark Randis or any other judges, emails, portals, or otherwise except the official entry form through Google Docs. It is HIGHLY recommended that all entrants complete their entries in MS word, notes on their phone, or another writing program as entries will NOT be emailed back to entrants and/or to prevent the loss of the entry given a power outage, website, or other technological error. All applications must be sent via the portal provided to keep entrants anonymous to the judging panel. No emails or faxed applications will be accepted. This format guarantees that your application is official and properly reviewed.

No purchase necessary: Entrants can choose to mail in a handwritten no purchase necessary entry instead. Additional information below.

 Judging

All eligible entries received will be judged on the criteria of: (1.) The compelling nature of the entry (i.e., how well the story is presented); (2.) Successful entries will answer all aspects of the writing prompt (3.) winners are chosen on merit, creativity, and writing skill. BLIND JUDGING: All applicants are given a confirmation number for submissions via an automatic email, marked only with an identification number unique to your submission and a link to the prompt itself and rules/FAQs.  

This double-blind process ensures that applicants are judged solely on their submission, and judges do not know who the applicants/winners are until a winning submission is chosen. All in the interest of keeping the applicants anonymous and the judging blind. All decisions of the judges are final. All qualifying essays will be judged blind through several rounds of judging. All potential winner essays will be fed through both plagiarism identifier software and AI identifier software to ensure the essays are authentic and original. All decisions of the judges are final.

SUBMISSION

  • Fill out the registration form. All fields on the online form are required

  • Registration forms must have an order number attached from purchasing an entry ticket. It is to the entrants advantage to review the essay to make sure it is complete, contains all the necessary forms filled in, and addresses the topic/writing prompt provided. If an entry is submitted several times only the FIRST entry will be recognized and judged (entries are dated and time stamped upon submission).

  • Do not place your first or last name/your school's name/job location or ANY IDENTIFYING INFORMATION WHATSOEVER in the essay. Only the registration form when first purchasing your ticket should include this information so we can contact the appropriate winners.

  • Faxed, emailed, or Dm’ed submissions via social media will not be accepted and will DISQUALIFY any entrant without refund.

  • Your essay will be disqualified if it does not meet the requirements or is submitted after the submission dates and times provided.

  • Length: Lengths will vary month by month but typically should not exceed 1,000 words. If you can text a friend about your day, you can apply easy peasy. You are NOT judged based on grammar, spelling, length etc; we want to know the people behind the stories and prompts. That can be 3 sentences or 3 paragraphs. The prompt itself does NOT need to be part of the essay you submit. You may add it on if it does not impede your ability to tell your full story. If you need the extra space, leave the prompt off and start your story from where the prompt ends.

·       During the Entry Period, Submissions cannot be displayed or distributed except by Sponsor, and you must maintain all rights, without third party obligations, to transfer your Submission to us if you are selected as a Winner.

·       Except for materials that are in the public domain, each Submission, in its entirety, must be a single work of original material created by the entrant, or for which entrant has all rights required to comply with these Official Rules, and suitable for presentation in a public forum.

·       Submissions must not include material that: (a) is sexually explicit, indecent, obscene, violent, hateful, tortuous, defamatory, slanderous or libelous, (b) is derogatory or promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, (c) invades the privacy or publicity rights of any person, living or deceased, (d) is unlawful, (e) is harmful to other users of the Website such as viruses, Trojan horses or other technologies that could adversely impact the Contest, (f) is appealing to children, (g) depicts overconsumption of alcohol and/or (h) is disparaging to Sponsor or is inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate (at Sponsor's sole and absolute discretion).

Submissions should not reveal any personally identifiable information about another individual, including another person's address, phone number, email address, credit card number or any information that may be used to track, contact, or impersonate that individual. 

KL Randis Writing Contests Pay Out

Funds are to be paid directly to winner via bank wire, venmo, or Paypal ONLY. All federal, state and local taxes and any other costs and expenses not specifically stated herein as being awarded are the winners’ sole responsibility. Winners may have to fill in and submit a 1099 form provided by Sponsor depending on your state and locality. No transfer, assignment, cash redemption, or substitution of KL Randis Writing Contest except by Sponsor who may substitute a KL Randis Writing Contest with one of equal or greater value, at its sole discretion. All KL Randis Writing Contest details are at the sole discretion of the Sponsor. There will be one KL Randis Writing Contest winner per applicable KL Randis Writing Contest available, unless noted otherwise. Receiving a prize is contingent upon compliance with these Official Rules. As part of the winner notification process, a potential prize winner will receive an email notification requiring the potential winner to submit a prize redemption form as a condition of receiving a prize. If any potential prize winner fails or refuses to complete such Redemption Form within the time period required by Administrator or if the Redemption Form is returned as rejected, faulty, unclaimed or returned as undeliverable to such potential prize winner, such potential prize winner may be disqualified. A potential prize winner who provides a P.O. Box may be required to provide an alternative address and this may cause a delay in notification and acceptance so use of a P.O. Box is discouraged. The Promotion Parties are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's email or other account to receive messages.

Winnings may not be transferred, sold, bartered, auctioned (including through Internet auction sites), given away, traded, or obtained through any source other than through the method described in these Official Rules. Any winners will be void if it fails to pass anti-fraud detection measures, or if determined by Sponsor, in its sole discretion, to be unauthorized, illegitimately obtained or if it contains an unauthorized message, code, or other marking not issued by Sponsor for use in the Promotion, or if it is defective, contains other mechanical/electronic errors, is produced in error, illegible, unreadable, or blank or contains a seeding, typographical, mechanical or other errors, or does not contain proper security devices. Sponsor's sole liability and responsibility for any irregular winner shall be limited to replacement of another KL Randis Writing Contest (while supplies last). Games that have been tampered with or altered are void. ANY PERSON ATTEMPTING TO DEFRAUD SPONSOR OR IN ANY WAY TAMPER WITH, DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION WILL BE DISQUALIFIED AND MAY BE SUBJECT TO CIVIL AND/OR CRIMINAL PROSECUTION. Sponsor may run multiple campaigns, contests, KL Randis Writing Contests or other promotions simultaneously. Entry into one (1) campaign, contest or KL Randis Writing Contests does not constitute entry into any other.

KL Randis Writing Contest Drawing/Odds

Odds of winning depend on the number of eligible Promotion Entries received and the date and time when a particular Promotion participant submits their Submission.

The potential winner(s) of the KL Randis Writing Contest portion will be selected through the discretion/opinion from judges from all eligible entries received in accordance with these Official Rules. Sponsor will have complete discretion over interpretation of the Official Rules, of administration of the KL Randis Writing Contests, and of selection of the winner(s). Decisions of the Sponsor as to the selection of the winner(s) for the KL Randis Writing Contests will be final. 

Winner Notification

Potential winners will be required to execute and return an Affidavit of Eligibility, Liability and (where legal) Publicity Release within 3 contact attempts of issuance of notification. Noncompliance with the foregoing, these official rules, Sponsor’s inability to make contact with a potential winner within a reasonable time period (24-72 hours) or KL Randis Writing Contest notification returned as non-deliverable, may result in disqualification and, at Sponsor’s discretion, a runner-up may be notified in their place as the winner. Publicity release will entail but not limited to Sponsor sharing the winning writing prompt on social media with or without winners name (first name and last initial) and/or photograph if provided/requested. Depending on the sensitivity of the writing prompt, it’s possible only the writing prompt response and winners first name be shared, but it is at the sole discretion of the Sponsor and the winner. We respect winners need and want for privacy but also need to adhere to legal and audit parameters set within. For the Festive Fortune 2023 payout, only the Grand Prize winner ($2k) will be able to have 3 tagged friends each receive $100.00 ($300.00 max). The $100.00 additional payout for this particular payout (to tagged friends in the comment section of KL Randis’ IG) does not apply to $1k winners, $500 winners, or Life Scholarship winners.

In an attempt to pay out winners in a timely manner if any potential winner fails or refuses to complete such Redemption Form within 3 attempts of contact from first date of notification or if the Redemption Form is returned as rejected, faulty, unclaimed or returned as undeliverable to such potential prize winner, such potential winner may be disqualified and an alternate may be selected. A potential prize winner who provides a P.O. Box may be required to provide an alternative address and this may cause a delay in notification and acceptance so use of a P.O. Box is discouraged. Sponsors are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's email or other account to receive messages. Attempts to contact winners will be made via the email and social media winners provide on the form during entry.

KL Randis Writing Contests are not responsible for and shall not be liable for late, lost, damaged, intercepted, misdirected, or unsuccessful efforts to notify or deliver funds to the potential winners, or if potential winner is a minor, for late, lost, misdirected, or unsuccessful efforts of potential winner to provide signed parental or guardian consent. The approximate retail value of the prize(s) is based on available information provided to Sponsor and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Unclaimed prize(s) will be forfeited. Prize(s), if legitimately claimed, will be awarded. The Promotion Parties are not responsible for and will not replace any lost, mutilated, or stolen prize(s) or any prize that is undeliverable or does not reach the winner because of an incorrect or changed address. If a winner does not accept or use the entire prize, the unaccepted or unused part of the prize will be forfeited, and the Promotion Parties will have no further obligation with respect to that prize or portion of the prize. No more than the stated prize(s) will be awarded.

Due to limited resources, we are unable to notify all applicants who are not winners of a KL Randis Writing Contest. Only winners will be notified. All winners are announced on our website and via social media.

  • Mail-in submissions must include: Your hand written submission to the prompt in an envelope that has a return address in the left hand corner ONLY (NO NAME). A submission with the same word length guidelines (1,000 words max), and a separate sealed envelope inside of the mailed entry envelope that includes the following information: Full first and last name, email address, and phone number in the event you are chosen as the winner to keep the submission blind to the judges AND a copy of your government issued ID to verify you are over the age of 18 and reside within the United States.

  • ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.

General Conditions

By participating, each entrant agrees (i) to be bound by the terms of these Official Rules and the decisions of the Sponsor and judges, which shall be final and binding in all respects; (ii) to release Sponsor, KL Randis, and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively, the “Released Parties”) from any liability, loss, injury or damage to entrants or any other person or entity, including personal injury or death to participants or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of entrant’s participation in this program, the use of any entry or acceptance, possession, use or misuse of a KL Randis Writing Contest, and any claims based on rights of privacy, rights of publicity and/or copyright infringement; (iii) to indemnify and hold harmless the Released Parties from any liability, loss, injury or damage related to entrant’s participation in this program, the use of any entry or acceptance, possession, use or misuse of a KL Randis Writing Contest, and any claims based on rights of privacy, rights of publicity and/or copyright infringement and (iv) to the use by Sponsor and its designees of his/her name, city and state of residence, likeness, voice, actions and biographical information for advertising and promotion purposes in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification permission, unless prohibited by law. Should any portion of the program be, in Sponsor’s sole opinion, compromised by non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the program and select the potential winners from all eligible, non-suspect entries received prior to such action using the judging procedure outlined above. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, submissions. Released Parties are not responsible for printing, typographical, technical, telephonic, computer, human, network or other errors relating to or in connection with the program, including, without limitation, errors which may occur in any program related materials, the administration of the KL Randis Writing Contest program, the processing or judging of entries or the announcement of the KL Randis Writing Contest; for stolen, lost, late, misdirected, inaccurate, undelivered, damaged, delayed, garbled, illegible, incomplete or postage-due entries or mail. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems, human error or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to individual’s or any other person’s computer relating to or resulting from participation in this program or downloading any materials in this program. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE KL RANDIS WRITING CONTEST PROGRAM IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. 

In the event Sponsor is prevented from continuing with the Promotion by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Promotion by any party, hospitalization, or any federal, state, local or government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor's control (each, event or occurrence), Sponsor’s health condition or hospitalization, Sponsor shall have the right to modify, suspend, extend or terminate the Promotion or prize. In addition, if the number of tickets sold does not cover the prize monies to be paid out to the winner, Sponor has the same above ability to modify, suspend, extend or terminate the Promotion or prize Sponsor additionally reserves the right, in its sole and absolute discretion: (a) to modify, suspend or terminate the Promotion should causes beyond Sponsor's control corrupt or interfere with the administration, integrity, operation, security or proper play of the Promotion; or (b) to disqualify any entrant found to be, or suspected of: (i) tampering with the entry process or the operation of the Promotion; (ii) acting in violation of these Official Rules; or (iii) acting in an un-sportsmanlike manner or (c) threshold to cover KL Randis Writing Contest prize amount is not met by entrant fees. Example: If in the month of June not enough ticket sales are sold to cover payout for the winner of the KL Randis writing contest AND the Life Scholarship, Sponsor can keep the contest open and roll over into the following month to try and obtain more ticket sales.  

RELEASES: All participants, as a condition of participation in this Promotion, agree to release, discharge, indemnify and hold harmless and indemnify the Promotion Parties and each of their respective directors, officers, employees, agents, successors and assigns (collectively, the Released Parties) from and against any and all liability, claims, costs (including attorneys' fees), losses, damages, fines, or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained, in whole or in part, directly or indirectly, in connection with: (i) participation in any aspect of the Promotion (including travel to/from any Promotion activity), (ii) the receipt, ownership, use or misuse of the prize awarded, including any travel associated with any prize, (iii) the Released Parties' violation of rights of publicity or privacy, claims of defamation or portrayal in a false light or based on any claim of infringement of intellectual property; (iv) participant's registration material on any related website, or (v) any typographical, human or other error in the printing, offering, selection, operation or announcement of any Promotion activity and/or prize.

GOVERNING LAW AND LIMITATION OF LIABILITY: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants, Sponsor or the Released Parties in connection with the Promotion will be governed by and construed in accordance with the internal laws of the State of Washington, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws. BY ENTERING THE PROMOTION, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROMOTION, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS' FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) ENTRANTS' REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

DISPUTE RESOLUTION: The parties each agree to finally settle all disputes only through arbitration; provided, however, the Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts in the State of Pennsylvania, and any other court with jurisdiction over the parties. In arbitration, there is no judge or jury, and review is limited. The arbitrator's decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Promotion shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures. If an in-person hearing is required, then it will take place in the State of Pennsylvania. The federal or state law that applies to these Official Rules will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn't apply and the dispute must be brought in a court of competent jurisdiction in the State of Pennsylvania. Sponsor agrees to pay the administrative and arbitrator's fees in order to conduct the arbitration (but specifically excluding any travel or other costs of entrant to attend the arbitration hearing). Either party may, notwithstanding this provision, bring qualifying claims in small claims court.  In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Promotion-related materials, privacy policy or terms of use on any website, social media platform or application and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsor's sole and absolute discretion.

 

LICENSE TO SUBMISSIONS: Entrant, upon submission of his or her Submission to the Contest, irrevocably grants to Sponsor, and each of its licensees, successors and assigns, the non-exclusive, perpetual, royalty-free, no-cost license and right to use and otherwise utilize the Submissions, and all images, text and materials included or depicted therein, in whole or in part, in any manner or medium now or hereafter known or devised (including, without limitation, CDs, streaming media, film, television, videocassettes, print, interactive devices, mobile media, Internet and on-line systems), throughout the universe and in any and all languages, including, without limitation, the right to display, reproduce, recreate, record, perform, exhibit, distribute, copy, edit, change, modify, add to, subtract from, re-title and adapt the same, to combine it with other material and otherwise use and exploit it without having to give any compensation or attribution to entrants or any third party, except for the awarding of the prize to the Winner in this Contest. Entrants agree that during the Entry Period, they shall not make, and shall not permit, any other public use, display or distribution of the Submissions, and they shall maintain all rights without encumbrances so that, if Sponsor desires, entrants can assign all rights in and to Submissions if selected as a Winner. Sponsor, and each of its successors, assigns and licensees, will have the right to make unlimited derivative works of Submissions, to assign or transfer any or all of Sponsor's granted rights and to grant unlimited, multiple-level sublicenses. Without limiting the forgoing, Sponsor will have the right to use the Submissions submitted as part of the Contest, and all images, text and materials included or depicted therein (if any), in any merchandising, advertising, marketing, promotion or for any other commercial or non-commercial purpose. Entrants hereby forever waive and relinquish all rights now or hereafter recognized in connection with Submissions submitted as part of the Contest. Entrants acknowledge that as a condition of participating in the Contest and/or being selected as a Winner, Sponsor may request that the entrant's Submission, and any rights therein, be assigned to Sponsor and entrants may be required to confirm such assignment by completing and submitting the Affidavit (defined below) (and any other documents reasonably required by Sponsor) or such entrant will otherwise be disqualified from receiving his/her prize(s). Entrants must maintain the ability to assign all such rights to Sponsor free of any limitations, restrictions or third-party obligations. Entrants agree that Sponsor shall have the sole discretion in determining the extent and manner of use of Submissions and are not obligated to use any Submission. Entrants agree that Sponsor, nor its agents, shall be responsible for return or preservation of the Submissions submitted. All Submissions that are posted on the Website or elsewhere are available to be viewed by anyone with access to the Internet.
Each entrant acknowledges that Submissions are not being submitted in confidence or in trust to Sponsor and that no confidential or fiduciary relationship is intended or created. Each entrant acknowledges that Sponsor and other entrants may have created ideas and concepts contained in their Submissions that may have familiarities or similarities to his/her own Submission, and that he/she will not be entitled to any compensation or right to negotiate with the Promotion Parties because of these familiarities or similarities. Notwithstanding any custom and practice in the industry to pay an individual for an idea (if any), nothing herein shall create an implied or express contract to compensate entrants for their Submissions and there is no obligation for any Promotion Party to pay or otherwise compensate entrants for any of their ideas or materials in any communications with Sponsor, whatsoever. Submissions are not confidential and the Promotion Parties' only obligations to entrants regarding Submissions are as specifically set forth in these Official Rules. The decisions of the Sponsor are final and binding in all matters relating to this Promotion, including interpretation and application of these Official Rules. Entrant, by participating in the Promotion, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval. Sponsor reserves the right to request from entrant at any time proof that entrant maintains all necessary rights in their Submission in order to grant Sponsor the rights required herein in a form acceptable to Sponsor. Failure to provide such proof may lead to, among other things, the entrant being disqualified from the Promotion. 

Use of Entry

By submitting an entry, entrant agrees Sponsor, its member organization licensees and its agents shall own the entry submitted (including all rights embodied therein) and that it and its designees may display, edit, modify, and distribute the entry and all elements of such entry, including, without limitation, the names, likenesses, voices and actions of any persons or locations embodied therein, in any and all media now known or not currently known, throughout the world in perpetuity without compensation, permission or notification to entrant or any third party. You further grant KL Randis Writing Contest by KL Randis the right to allow promotional materials, including your name, likeness, and photos that are included with your Entry to be embeddable by the public via (included but not limited to) YouTube or other online video, photo or social media services or sites.
